- Application of the general conditions of sale
Lily Cosmetics reserves the right to adapt or modify these general conditions of sale at any time.
1.2 The version of the T&Cs applicable to any sale is that appearing online on the website www.lilymescosmetics.com at the time of the order.
1.3 Consequently, placing an order requires the customer's full, prior and unreserved acceptance of these T&Cs.
2. PRODUCTS
2.1 The products and services offered are those listed in the catalogue published on the Site. Each product is accompanied by a description established by the supplier listed on the site.
2.2 The products sold by Lily Mes Cosmetics are those present on the site on the day the customer consults the site and within the limit of available stocks. These indications are updated as often as possible.
2.3 The customer is informed that the photos, colors, videos, dimensions and other characteristics of the items displayed on the site could be altered by the Internet browser used and the definition of the screen used.
2.4 However, Lily Mes Cosmetics ensures that the representation of the photos and videos appearing on the website is as close to reality as possible.
3. PRICES
3.1 All prices presented on the Site are in euros, all taxes included. Lily Mes Cosmetics reserves the right to modify its prices without notice. The prices applied to the Customer correspond to those displayed on the Site at the time of his Order.
4.ORDERS
4.1 The customer places an order on the website " www.lilymescosmetics.com ". The ordering process includes several steps. After choosing their products and validating their basket, the Customer must confirm their contact details, the total amount and all the elements of the order. The final validation of the order entails acceptance of the prices and descriptions of the products available for sale.
4.2 The customer can select as many products as he wishes. The basket summarizes all the products chosen by the customer and the corresponding prices. The customer can, if he wishes, modify his basket before final validation of the basket.
4.3 All orders are validated after acceptance of payment.
4.4 Orders are accepted definitively within the limit of available stocks. The unavailability of a product does not engage the responsibility of the seller and does not give the customer any right to compensation or damages. The final validation of the order entails acceptance of the prices and descriptions of the products available for sale.
4.5 After validation of the order by the seller, the customer receives a confirmation by e-mail.
4.6 The customer accepts the use of e-mail as part of the order confirmation.
5. PAYMENT
5.1 Payment is due immediately on the date of the order, including for pre-ordered products. Payment can be made by credit card, PayPal, bank transfer or any other means offered by the Site.
6. DELIVERY
6.1 Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.
6.2 It is specified that the amount of delivery costs may vary depending on the territory of delivery of the products, which the Customer expressly acknowledges and accepts.
Delivery times are indicated on the Site and depend on the delivery method chosen by the Customer.
6.3 For Reunion Island, orders are prepared within 2 working days following confirmation of your order. Please note that this period only applies to working days, i.e. Monday to Friday. Orders placed on Saturday will be processed the following Monday. No shipments are made on Sundays.
6.4 The delivery time to Reunion Island is estimated between 1 and 2 working days from the dispatch of the order. Consequently, the total time between the order and the receipt of your package may vary between 3 and 4 working days. In addition, we cannot be held responsible for any delay due to circumstances beyond our control (strikes, weather conditions, etc.).
7. PERSONAL DATA
7.1 The delivery addresses collected are confidential data, and are therefore only used by the delivery person, who uses them in order to be able to deliver the order to the given address.
7.2 The telephone number may also be used by Lily Cosmetics itself in a professional context to contact the customer in order to transmit any information concerning the customer's order.
7.3 Telephone numbers and other information remain in our database and are not disclosed, sold, or used for any purpose other than those listed above.
8. WITHDRAWAL
8.1 In accordance with the legal provisions in force, the Customer has a right of withdrawal of 14 days from receipt of your order, without having to provide reasons or pay penalties. This right only applies to unopened, unused products returned in their original condition.
8.2 Exclusions from the right of withdrawal:
The right of withdrawal cannot be exercised for sealed products that have been unsealed after delivery, and which cannot be returned for reasons of hygiene or health protection, in accordance with Article L221-28 of the Consumer Code. Consequently, unsealed shea whipped creams cannot be refunded or exchanged.
8.2 To exercise your right of withdrawal, you must notify us of your decision by e-mail to [your e-mail address] or by post to the following address: [your postal address], stating your order number and the products concerned. We will confirm receipt of your request and inform you of the return procedures.
8.3 The products must be returned at your expense, within a maximum of 14 days following the communication of your decision to withdraw. We advise you to choose a return method with tracking, as we cannot be held responsible in the event of loss or damage to the products during transport.
8.4 Subject to compliance with the above conditions, we will refund you in full the sums paid for the returned products, excluding initial delivery costs, within 14 days of receipt of the returned products. The refund will be made via the same means of payment as that used when ordering, unless you expressly agree to another means of refund.
8.5 In case of non-conformity of the products received or a problem encountered, do not hesitate to contact us to find a suitable solution. We are at your disposal to answer all your questions and concerns.
9. INTELLECTUAL PROPERTY
9.1 All elements present on our website www.lilymescosmetics.com and related to our company, including, but not limited to, texts, images, graphics, logos, videos, icons, sounds, as well as the products themselves and the recipes of our shea whipped creams, are the exclusive property of Lily Mes Cosmetics. These elements are protected by intellectual property law.
9.2 Any reproduction, distribution, modification, adaptation, retransmission or publication, even partial, of these different elements is strictly prohibited without our express, written and prior authorization. Any unauthorized use of these elements engages the responsibility of the user and may result in legal proceedings.
9.3 The purchase of our products does not in any way confer on the buyer any right of ownership or use over the elements protected by intellectual property, with the exception of the private and personal use of the products purchased.
The trademarks and logos, whether registered or not, appearing on our site or our products, as well as the trade names and company names, are also protected by trademark law. Their use or reproduction, without prior authorization, is strictly prohibited.
We reserve the right to take all necessary measures to protect our intellectual property rights, including taking legal action in the event of infringement. 10. LIMITATION OF LIABILITY
10.1 In the event that the liability of Lily Mes Cosmetics should be established and retained due to damage suffered by the Customer and exclusively to Lily Mes Cosmetics , this is limited to the amount of the Order paid by the Customer to Lily Mes Cosmetics .
10.2 The User acknowledges that his/her use of the Site is at his/her own risk. The Site is provided to him/her "as is" and is accessible without any guarantee of availability and regularity. Lily Mes Cosmetics will make every effort to make the site accessible 24 hours a day, seven days a week, except in the event of force majeure or an event beyond the control of Lily Mes Cosmetics and subject to maintenance periods, possible breakdowns, technical hazards linked to the nature of the network or malicious acts or any damage to Lily Mes Cosmetics' hardware or software. 10.4 The Customer undertakes to use the Products in strict compliance with the instructions for use provided by Lily Mes Cosmetics . Consequently, Lily Mes Cosmetics cannot be held responsible in the event of non-compliant use of the Products by the Customer or a third party.
